V. Narendra's book explains that Under Article 141 of the Constitution of India, the High Courts or any other Court for that matter in the country have to follow the law laid down by the Supreme Court, the highest court of the country. The Apex Court apart from other decisions has observed in Kumar Neotia Vs. Union of India (AIR 1988 SC 1353), that if the Supreme Court laid down the law or guidelines on an issue, even if some issue raised by the High Court has not been touched by it, such law or guidelines becomes the ultimate and becomes binding on all courts in the country. The Courts below neither can question such decisions nor can overrule them. The Supreme Court on its part had occasions to deal with almost all facets of the provisions of Chapter XVII of the NI Act. especially Section 138. And those aspects of cheque and its dishonour has been dealt and answered by it.

Though, initially these provisions had to sail through the troubled waters now almost every question relating to dishonour of cheque is settled by the Supreme Court. Thus, all the aspects of this branch of law have evolved into definite propositions through various decisions rendered by it Therefore, if any problem relating to dishonour of cheque is posed to any court, all that such a court has to do is fit in the facts of the case on hand into the equations evolved by the Supreme Court and give quietus to the lis.

That is why, while dealing with any such aspect of dishonour of cheque, that has been already decided by the Supreme Court, citing any number of decisions rendered by other courts will have only persuasive value. Here, an attempt is made to deal with several such aspects of Section 138 in the form of questions and these questions are answered by the ratios handed over to us by the Supreme Court through its decisions.

All that the reader has to do is, first find out what is the problem regarding dishonour of cheque he has on hand, then, straight away if he goes to that question in this book, he will find that, his question is answered invariably by the Supreme Court
